The biggest threat to the republic is the administrative state

The US Constitution sans Amendments prints out to about 12 pages.   The total printed material, amendments and all, is only 21 pages.  If the founders were around today, I’m sure they would agree that there needs to be a few more pages.  The rather plainly written language contained in the constitution deal power equally among three branches is sort of irrelevant these days.

Take the judiciary.  This is the branch that is least accountable to people.  The judiciary is supposed to be constrained by the US Constitution not elections.  It is their job to hold the other two branches to what is supposed to be the supreme law of the land.  It is pretty clear that in today’s world, where the Lefty Libs are unable to win elections, the leftist in the judiciary are using its constitutional power as a pseudo Article I branch.

No one needs to look any farther than the 9th Circus Court – the favorite venue for Lefty Libs when they go judge shopping to reverse state-wide ballot questions and what they consider unfavorable laws and/or executive orders.  But Lex that’s their job.  Okay fine.   I just find it curious that it always seems to be the Lefty Libs making stuff up out of whole cloth to support their whacky opinions.

I’m still mystified by Roe V. Wade case.  Who the heck knew there was a 4th Amendment right to an abortion?  Had the court left this issue where it belonged – the states – it would not have become the divisive issue that it has for last 50 years.

Lex regularly refers to judges as “dopes in robes.”  The 9th Circus gets reversed 80% of the time.  What the heck?  An 80% failure rate in any other endeavor – aside from hitting a baseball at the major league level – would be grounds for automatic dismissal.  Why do these boobs still have jobs?

But the judiciary is just one example of government not acting within the constraints laid out in the constitution.   Why do we have something called a “special prosecutor”?  That whole lash up seems extra constitutional to me.  Why do have a “special commission” formed every time a sensitive issue - like military base closure – crops up?

I’m of the opinion that these things come to life when our duly elected representatives do not want to touch a political hot potato.  In short – they are cowards.  They are afraid to face voters for doing their job.  So they farm politically sticky issues out to unelected unaccountable “specialists.”  Every time these things are farmed out to some “special” entity, accountability to voters disappears.  When that happens it is no longer a government of “We the people.”

But hiring “specialists” to do the job of elected officials, is only the tip of the iceberg of what has become known as the unelected unaccountable “administrative state.”  Unelected and unaccountable government bureaucrats in every branch of government are running our lives.  Every government agency it seems has an armed component.  They pass rules and regulations without comment from the public or our elected representatives.  They make arrests.  They assess fines and fees for nearly every common activity.

Sadly the administrative state is largely political.  Combine that fact with the fact that the overriding imperative of any bureaucracy is to grow the bureaucracy and the mess we’re in becomes apparent.  The administrative state bureaucracy has been growing in borg-like fashion for 40+ years and is largely a vehicle for leftists who love big government.

So how do you dismantle the borg?  The same way you eat an elephant, one piece at a time.  Robertscare has to go.  Mueller has to go.  Congress should find out how many government agencies have armed components and get rid of preposterous armed agents at say the Department of Education. Institute an absolute hiring freeze until every agency in the federal government has had its personnel reduced by at least 10%.

I do not know how the founders would have guarded against what has happened to their proposed government.  I just know that something would have been done.  IMHO, the administrative state is the biggest threat to the republic.  It will continue to be a problem as long as we the people continue send the same cowardly crew to represent us in Caligula, D.C.

"No method of procedure has ever been devised by which liberty could be divorced from local self-government. No plan of centralization has ever been adopted which did not result in bureaucracy, tyranny, inflexibility, reaction, and decline. Of all forms of government, those administered by bureaus are about the least satisfactory to an enlightened and progressive people. Being irresponsible they become autocratic, and being autocratic they resist all development. Unless bureaucracy is constantly resisted it breaks down representative government and overwhelms democracy. It is the one element in our institutions that sets up the pretense of having authority over everybody and being responsible to nobody."
Cal Coolidge
